5. SUB-COMMITTEES

5.1 DISCIPLINARY SUB-COMMITTEE

5.1.1 Case 01-2023

Respondent, Complainants, Clubs and Provincial Councils informed of finding and penalties

The Respondent’s lawyer has requested that they be given the full reasons for the finding and penalties imposed and have stated that it is their Client’s intention to lodge an appeal against both the finding and penalty. They have 15 working days within which to lodge the appeal .

5.1.2 Case 02-2023

Disciplinary Hearing was held on 01.06.2023.

Exco is hereby notified of the DSC’s decision and record of finding and penalty.

The record of the DSC’s proceedings is attached for consideration and confirmation.

5.2 SHOWS

5.2.1 Applications for Second Championship Show

5.2.1.1Western Province Bull Terrier Club – 21.10.2023

The above Club is applying for a second Championship Show

Motivation: Hosting a second Championship Show in conjunction with two All-breeds Championship Shows would possibly increase entry numbers and would be beneficial to all Clubs involved as well as respective exhibitors in reducing travelling expenses and offering Terrier exhibitors 3 CC opportunities.

5.2.1.2 Utility Breeds Club of Gauteng – 04.11.2023

The above Club is applying for a second Championship Show for Breed and Disciplines. They wish to offer more shows on their weekend to encourage exhibitors to attend.

5.2.1.3 SA Short Legged & Working Terrier Club – 24.03.2024

The above Club is applying for a second Championship Show for Breed. They would like to bring an International Terrier Specialist Judge to SA.

5.2.2 Show Return Penalties (Schedule 08)

Concern was expressed at the financial impact some of the pre-show and post-show penalties that had

been levied on Clubs would have. It was decided that a review of the penalty structure and the Regulations governing penalties be undertaken, with the aim of Exco submitting a proposal to Fedco for consideration.

5.2.2.1 Port Elizabeth Cluster Weekend – 29.03.2023 – 02.04.2023

The organising committee of the above 7-show weekend is requesting that penalties be reduced by way of giving leeway to the Judges’ contract dates .

Request to waive payment of Show penalties was denied. Instead, lenient payment terms were offered. Payment of the invoice within 30-days is waived on the proviso the penalty is paid in full prior to the end of current financial year (31 August 2023).

5.2.2.2 SA Short Legged & Working Terrier Club – 13.05.2023

The Club is seeking the withdrawal of penalties due to another Organising Club taking responsibility for the Show Documents .

Request to waive payment of Show penalties was denied. Instead, lenient payment terms were offered. Payment of the invoice within 30-days is waived on the proviso the penalty is paid in full prior to the end of current financial year (31 August 2023).

5.2.2.3 Transvaal Working Trials Association – 09.04.2023

The above Club is requesting leniency with regards to their penalties imposed for their Working Trials Show.

5.2.4 Entry in contravention of the Regulations in Schedule 3:

5.2.4.1 The Office received a Champion and Junior Merit application for Zena Bupepe Iz Moskovskoy Bemty of Boupeep (ZA001097C22).

It was decided at Exco 05-2023 that the awards won were to be withdrawn.

An urgent appeal was lodged, which was sent to Exco via email as a round robin vote on 19.05.2023

The round robin vote failed (3 against; 1 for; 2 abstentions)

The Registered Owner ubmitted a further request for Exco to reconsider their decision. (see attached).

Decision to withdraw awards is upheld.

5.2.4.2 Junior Merit Application – Wilbod Savannah Night Sky (ZA006270B22)

An application was submitted to the Office for a Junior Merit title for the abovementioned dog whereupon it was discovered that the was not a member of KUSA. The Owner was sent a Membership Application Form on 09.06 .2023.

Awards may be retained on proviso that owner applies for Membership within two weeks.

5.2.4.3 Junior Merit Application – Rumox Olympus (ZA010365B22)

An application was submitted to the Office for a Junior Merit title for the abovementioned dog whereupon it was discovered that the Owner was not a member of KUSA. The Owner was sent a Membership Application Form on 09.06.2023 .

Awards may be retained on proviso that owner applies for Membership within two weeks.

5.2.5 Schedule 3 Reg. 14 & Reg. 19.8 – Exclusion of Dogs

5.2.5.1 Temporary Exclusion Order – Bullmastiff – Aire Del Norte De El Guardian Del Bosque of Lemietrivier – Reg No. ZA001047C19

It was reported that the abovementioned dog acted aggressively at the Swartland Kennel Club (1) Championship Show held 22.04.2023 where it reportedly attacked a Bearded Collie. The Office contacted the Club on 08.06.2023 to obtain the documents in the correct format.

5.2.5.2 Temporary Exclusion Order – Australian Shepherd – Limited Kascaro of Modailene – Reg No. ZA001023C22

The Office received a report of an alleged incident of aggression that occurred at Swartland Kennel Club (2) Championship Show on 21.04.2023. The Club has submitted the relevant information, but the Office is following up to secure the documentation in the correct format (see attached). The Owner has submitted a statement (see attached).

5.2.5.3 Temporary Exclusion Order – Staffordshire Bull Terrier – Delu Lady Luck – Reg No. ZA006185B15

The Office received a report of an alleged incident of aggression that occurred at North West Staffordshire Bull Terrier Club Championship Show held 05.05.2023. (see attached)

5.2.5.4 Temporary Exclusion Order – Rhodesian Ridgeback – Eskhaleni Gem of Mnumbumba – Reg No. ZA005860B22

The Office received notice of an alleged incident of aggression that occurred at Hottentots Holland Kennel Club Non-Championship Show on 04.06.2023 where the dog bit the Judge. The Club has submitted a copy of the Incident Report Form (Annex A) and a statement from the Judge (incorrect format) and Ring Steward (correct format) (see attached).

Decision pending as at time Agenda was compiled.

Preliminary TEO to be issued and KUSA Office to request documentation.

5.2.5.5 Temporary Exclusion Order – Pembroke Welsh Corgi – Unknown

The Office received an enquiry regarding an alleged incident of aggression that occurred at the KUSA Nationals Championship Show on 28.05.2023. The Club has verbally informed the Office that they did not deem it to be an Incident in terms of clause 8.3 of the TEO Manual.

5.2.5.6 Temporary Exclusion Order – Golden Retriever – Savannalands Maverick – Reg No. ZA003232B19

It was reported that the abovementioned dog acted aggressively at the George Kennel Club (1) Championship Show held 09.06.2023 where it reportedly attacked another Golden Retriever. The Club has only submitted the Incident Report Form (Annex A) and all statements are still outstanding.

5.2.7.3 KUSA Classic 2024

The KZN Provincial Council Chairman, Mr Michael Vorster, lodged a formal application on 13.06 2023 to host the KUSA CLASSIC 2024 Event.

The following documents were submitted in support of the application.

• Letter to EXCO

• Estimated Budget for the 2024 KUSA Classic Weekend

• Organogram, including the responsibilities of each team member.

• Example of how the judges could be allocated – will be refined once confirmation of the event is confirmed.

• Estimated timetable for the weekend. – will be refined once confirmation of the event is confirmed

The Application to host the KUSA Classic 2024 event was unanimously approved. Final budget to

be submitted asap. The Organising Committee must submit monthly status reports.

5.3 JUDGES EDUCATION COUNCIL (JEC) –Nil .

5.4.1 Article 25.2 Judges shall maintain continuous and unbroken membership of the Kennel Union from the time their formal studies or activities towards a judging qualification commence until their voluntary retirement from judging, advised in writing to the Executive Committee, or their incapacitation (at the discretion of the Executive Committee), or their death.

5.21.1 Trick Dog now has its own Instagram page. In the first 2-weeks of being up and running, it has gained 111 followers. Posts to date have introduced the Evaluators which has been met with much appreciation and comments about being glad to put a face to a name. Future plans are a weekly challenge on tricks and a ‘who does it better’ fun post for voting.

9. ANY OTHER BUSINESS

9.1 Applications for Club Affiliation/Notification of Closure

9.1.1 Notification of Club Closure

Natal Coast Kennel Club held their AGM on 15.02.2023 where it was agreed to close the Club. It was further agreed that remaining finances were to be donated to the Highway Kennel Club.

However, the office noted some apparent irregularities in the financial statements for financial years ending 2021 and 2022. These have been discussed with KZN Provincial Council Chairman Michael Vorster who has agreed to investigate further. Annual Financial Statements attached to Agenda.

MH to liaise with KZN Provincial Council Chairman – Mr M Vorster and report back at the next Exco meeting. See attached response from the Club.

Natal Coast Kennel Club have submitted revised financials for 2021 and 2022.

The revised Financials submitted did not meet requirements. Carried forward from previous meeting.

The Club has since requested more information from the auditors on 07.06.2023 as all books were handed over to them.

MH and YJ to liaise with Michael Vorster regarding the outstanding financials.

9.1.2 Bearded Collie Club of Gauteng will be hosting their AGM on 28.05.2023 and have included an item to dissolve the Club.

MA reported that the reason for the decision to dissolve the club was due to lack of support at KUSA Events. BJ proposed that MA suggest that the Club be changed to a Herding Club. MA to propose this suggestion at the next AGM and report back on the final decision.

The Club hosted their AGM on 17.05.2023 but as no quorum was reached, the meeting was postponed to 24.05.2023. The Agenda contained an item to dissolve the Club. In terms of the Constitution, a quorum at an AGM must consist of 10 members with voting rights. However, the Club currently only has five (5) paid up members. All members voted unanimously in favour of dissolving the Club. It was agreed that the remaining funds would be used for a stand at PetExpo to promote the breed. (See attached)

9.1.3 Club Affiliation

Objection to new Club - Working Weimaraner Club

The KUSA Office received notification of a possible new Club forming on 28.03.2023. The Club provided details of their new Committee and a Letter of Support and requested a Constitution be drafted for them. The Club had consulted with DOGSPC regarding the process to form a Club and had also been in touch with the Field Trial Liaison Council.

Subsequently, objections were received from The Weimaraner Klub on 20.04.2023 and 10.05.2023.

CPA to draft a letter offering that BJ act as intermediary to mediate between the two parties.

A further e-mail has been received from Mr Frank Winder together with a letter from the Rainbow Hungarian Vizsla Club and attached to agenda.

The affiliation documents for the Working Weimaraner Club are attached. Ratification of the Club by the Provincial Council is on the NAPC Agenda whose meeting was postponed to 21.06.2023 .

Affiliation approved subject to acceptance by the NAPC.

9.1.4 Club Disaffiliations

Central Field Trial Club

The KUSA Office received a letter from the Central Field Trial Club on 14.04.2023 stating their intention to disaffiliate with immediate effect. No reason was given, and no response has been received to an email enquiring why. No further information received by the Office.

Noted that the Club was not closing but disaffiliating from KUSA.

The ED Xrays for the dam and sire were taken with the incorrect placement of the Elbows and the Scrutineer requested that the X-rays be redone.

The owner does not wish to redo the Elbow Xrays with the reason given that as per Schedule 2 Appendix C, the ED results are for record purposes only. The Rottweiler Breed Council was asked for their opinion. Attached please find response received from the RBC.

Not approved. ED X-rays to be redone if litter is to be registered.

10. GENERAL

10.1 Facebook page mentioning KUSA

The “KUSA (Ethical) Breeders” Facebook page is managed exclusively by a KUSA member. Recent changes to the administration of this site have led to changes such as the promotion of the members commercial interests. This could give the impression that KUSA endorses the products on offer.

Furthermore, KUSA has no control over the breeders being allowed to advertise / being promoted on the Facebook site. The Facebook page further links to a website “Breeder Listing South Africa” – although this website does not bear the KUSA logo or name, it does reference a kennel breeding “Bullies” and shows a picture of a dog with cropped ears.

The Office seeks guidance regarding requesting the removal references to KUSA from this page and the linked Websites.

CPA to write to Administrator of the Facebook page requesting that all references to KUSA be removed.

10.2 Canine Good Citizen

An Evaluator contacted the Office asking if it would be possible for her to test a dog via video submission. The Evaluator recently conducted an assessment in Hermanus and found a dog “Not Ready” for the Stay task in the CGC Bronze level. The handler has since trained the Stay and would like to have that one task retested and her dog signed off. However, the closest Evaluator is in Cape Town, some 120km away. They are thus asking for dispensation to complete the test via video submission.

10.3 YJ requested that the Show Schedule be included in the pack of documents circulated to the members of Disciplinary Sub-Committees when conducting Disciplinary Hearings.

10.4 YJ requested clarification as to the correct format in which Affidavits are to be submitted. PM advised that a template is available for download from the KUSA Website.

10.5 CP requested clarification on whether Ring Stewards are required to be members of KUSA. After discussion it was agreed that Ring Stewards are not required to be Members of KUSA.
