KENNEL UNION OF SOUTHERN AFRICA MINUTES OF A MEETING OF THE FEDERAL COUNCIL HELD ON SATURDAY & SUNDAY, 2 & 3 DECEMBER 2017 COMMENCING 08.30 ON SATURDAY AT THE KENNEL UNION OFFICES, 68 BREE STREET, CAPE TOWN

The Chairman opened the meeting and welcomed all present. He informed the members of Fedco that, after twenty-two years of service, Clr Joan Barrow had decided not to make herself available for re-election in the Eastern Cape & Border Provincial Council and would therefore no longer be attending the meetings of Fedco. He praised Clr Barrow for her generous ability to adapt and contribute to a new dispensation and thanked her for her contribution to the deliberations and decision-making of Fedco. The Chairman extended a warm welcome to Clr Barrow’s successor, Clr Lynn Scholtz, and assured her that all the members of Fedco were looking forward to working with her for the betterment of KUSA. 

As was customary when a new Federal Councillor was appointed, the Chairman briefly reminded all the members of Fedco of their responsibilities and obligations as enshrined in the Articles and of the important role Fedco members played in the governance of KUSA. The Articles vest the control and management of KUSA in Fedco and Federal Councillors shoulder a heavy burden of fiduciary duty and responsibility. 

The Chairman briefly reflected on the use of social media by KUSA members to criticise the efforts of those entrusted with the governance of KUSA. We are obviously all entitled to our opinions, but destructive comment achieved nothing and Federal Councillors should guard against getting involved in futile debates with members on social media. There were appropriate channels for members to air legitimate concerns and there was a strong imperative for those in leadership positions to moderate what they express on social media. 

The Chairman reminded the members of Fedco that South Africa was experiencing political and economic turmoil. Of some comfort was the realisation that we were not alone in this; Britain has Brexit, Germany and Spain have political division, the Middle East was in turmoil and China’s economy had stopped growing. We have been operating within the limitations imposed by our economy, evidenced by the reduction in show entries, and this was an important factor to be taken into account when planning ahead or making decisions.

The Chairman thanked the members of Fedco for their attention and wished them fruitful and constructive deliberations during the meeting. 

The Chairman requested all present to stand and observe a minute’s silence in honour of the following persons who had passed away since the last Fedco meeting: Alison Parkhouse (W Cape), Hendrik van der Merwe (GAU), John Hogberg (GAU), Janet Prince (EC), Caroll Reaney (GAU), Beryl van Druten,

Johan Gallant (KZN) (a Vice-President of KUSA), Peggy Pinnell (GAU) and Ian Bekker (GAU).

With a full complement of 9 Federal Councillors present, the Chairman declared a two-thirds majority for the changing of Articles and Schedules to be 6, whereas 5 would constitute a simple majority required for other decisions.

2. MINUTES 
The Minutes of the meeting held on 9 & 10 June 2017 were formally adopted and confirmed unanimously.

3. ADMINISTRATION MATTERS

3.1. Annual Report by the Chairman 
Report to be circulated with the Minutes. 

3.2. Audited Balance Sheet, Accounts and Auditors’ Report for the Year Ended 31.08.2017

The above documents had been circulated prior to the meeting.

After discussion it was resolved , unanimously, that the above financial statements be approved.

A 13th cheque for the staff, based on 50 per cent of salaries, was approved, as were salary increases, upon completion of appraisals.

3.3. Election of Auditor

3.4. Article 16.2.2

3.4.1. Election of Vice-Chairman (of the Federal Council) – Article 16.2.2.2 
The current incumbent, Clr JM Hubbard, retires on 31.12.2017.

The Chairman called for nominations for Vice-Chairman.

that Clr JM Hubbard be re-elected as Vice-Chairman of the Federal Council for a term of two years, concluding on 31.12.2019.

3.4.2. Election of Patron – Article 16.2.2.3

It was agreed at Fedco 12-2015 that any Fedco Councillor who had served four years, or longer, on the Federal Council may be nominated as a Life Member in recognition of services to KUSA .

LW enquired whether the same consideration of Life Membership after four years’ service could be extended to Exco members. Following discussion, it was agreed that LW should investigate the service records of Exco members and report back at Fedco 06-2018.

3.4.6. Appeals Committee – Article 16.2.3 
“The Federal Council shall nominate at least three (3) members of the Federal Council, who shall act as an Appeals Committee on behalf of the Federal Council to consider any appeals lodged in terms of the Disciplinary Rules.” 
Note: It is customary for all Federal Councillors to be elected to the Appeals Committee. Three members are appointed to consider Appeals as and when necessary.

3.5. Loss of Affiliation – Article 9

Note: The following ruling was made at Fedco 06-2017:

Effective 01.01.2018, no licences will be issued for either Championship, or Non-Championship, Shows, unless Clubs are up to date with all returns required in terms of the KUSA Constitution.

3.6. Specimen Club Constitution (Fedco 12-2015 item 11.1, Fedco 06-2016, item 3.4, Fedco 12-2017 item 3.7. Fedco 06-2017 item 3.4)

A draft document was presented and various aspects were discussed. 

LW indicated that she had perused the document and identified certain clauses requisite of adjustment. She undertook to advise GR of her findings to enable him to make the necessary changes before making the document available to Clubs.

3.7. Naming of Clubs (Fedco 06-2017 item 9.6) 
It was recognised that there was a need for greater flexibility in the naming of Clubs to make it possible for some Clubs to have a national reach. Federal Councillors were asked to apply their minds to a more flexible solution, based on the particular circumstances, focus and membership base of a new Club to replace the current rigid policy of geographical confinement.

3.8. Terms of Reference for Exco (Fedco 06-2016 item 9.1, Fedco 12-2016 item 3.13, Fedco 06-2017 item 3.6)

3.9. The Rosemary Elliott Memorial KUSA Junior Handler Fund (REMF) (Fedco 06-2017 item 3.9). 
KUSA’s contribution for the National Junior Handler competing at Crufts 2018 was agreed upon and PM undertook to inform Martine and Shea Wright of Fedco’s decision and provide them with a proposal for the disbursement of the available funds.

3.10. FCI

3.10.1. FCI – Non-Mandatory Commissions 
As agreed at December 2015 Fedco, representatives would either be Fedco Members, Conveners of National Sub-Committees, or persons deemed suitable by Fedco. Appointees must have a thorough knowledge of the subject/discipline in question.

Noted that the meetings of the FCI Judges and Shows Commission are due to be held at the end of February 2018 in Portugal. LW requested permission to attend at her own expense.

3.10.2. Feedback on the FCI General Assembly held in Leipzig, Germany, on 6 & 7 November 2017 
Report from Clrs Hubbard and Wilson, the two delegates who represented KUSA at the General Assembly. 

The Chairman thanked Clrs Hubbard & Wilson for representing KUSA at the FCI General Assembly at their own expense and invited Clr Wilson to present her report on the event. 

It was noted that Mr Rafael de Santiago (Puerto Rico) was elected President for a two-year term. Ms Carla Molinari (Portugal) was elected Vice-President and Member of the General Council for a four-year term and Dr Tamás Jakkel was elected Treasurer and Member of the General Council for a four-year term. Mr Gerard Jipping (the Netherlands) was elected to the General Council for a four-year term. 

Of particular interest to KUSA was item 15.2.1 on the General Assembly Agenda, the proposal from the Federación Canófila Mexicana (FCM) (the Mexican Kennel Club) for the FCI to cancel any agreements currently in place with the Verband für das Deutsche Hundewesen (VDH), or the Verein für Deutsche Schäferhunde (SV), or the Weltunion der Vereine für Deutsche Schäferhunde (WUSV). This proposal was unanimously carried by the General assembly (60 votes for, none against) and, on 10 November 2017, the President of the FCI, Mr Rafael de Santiago, informed the President of the SV and the WUSV, Prof Dr Heinrich Meßler, that the Cooperation Agreement between the FCI and the WUSV will terminate on 10 May 2018. 

The General Assembly was unable to reach agreement on proposed amendments to the Statutes and Standing Orders of the FCI and it was decided that an Extraordinary General Assembly would be convened in Brussels on a date to be advised in 2018 to specifically deal with the proposed amendments. 

The Chairman suggested the formation of a task team be formed under his chairmanship as the FCI portfolio-holder to assess the impact of the proposed amendments to the FCI Statutes and Standing Orders and any other matters relating to the FCI. This was agreed and JH, LW and GR were appointed to the task team. 

It was unanimously agreed that funds should be made available to permit KUSA to be represented by two delegates at the Extraordinary General Assembly.

3.11. Social Media Management and Web Artwork Design 
Freelance arrangement due for review.

Freelance arrangement on a retainer basis reviewed. 
During the ensuing discussion, it was reported that staff member Karene Karstadt was doing some of the work, but that some assistance was required with designing banners. CI indicated that she might be available to assist with this from February 2018.

Agreed , unanimously, that KUSA should terminate the freelance arrangement.

3.12. Boxer Register on Hold – Extension of Show Clearance Certificates issued 
At Fedco 12-2016, a directive was issued with regard to the issue of Show Clearance Certificates for Boxers. The first Show Clearance Certificate was issued in January 2017. 

Fedco is requested to grant permission for all Show Clearance Certificates issued to Boxers under this directive to be extended for a further twelve (12) months. The covering letter sent to each applicant states that KUSA reserves the right to withdraw the temporary Show Clearance Certificate at any time prior to the twelve-month expiry date, should there be a change in circumstances which would render the directive null and void.

Resolved , unanimously, that the Show Clearance Certificates be extended for a further twelve months from 01.01.2018, with the above proviso should there be a change in circumstances.

3.13. Schedule 2 Regulation 16 Breeder’s Restrictions (Endorsement) ( Exco 07-17 item 9.7, Exco 08-17 item 3.5) 
At Exco 07-2017, a request from a breeder was considered to place a Breeder’s Restriction on a dog nine (9) months after registration. Fedco upheld Exco’s recommendation that no Breeder’s Restriction should be placed on the dog concerned and the applicant (breeder) was advised accordingly.

3.14. Goldfields Showgrounds Supporters Club, Northern Gauteng (GSSC NG) & Goldfields Supporters Club, Southern Gauteng (GSSC SG) (Exco 09-2017 item 9.8) 
Request received from the Secretary of GSSC NG and GSSC SG for both the above-mentioned Clubs to be exempted from paying KUSA Show Levies on their Championship and Non-Championship Shows on an ongoing and permanent basis. 

Motivation: 
“These two Clubs were formed solely as a means of raising funds for Goldfields Showgrounds. We need to be able to keep them in the tip-top condition in which one finds them today so as to be able to hold Breed shows, Working Disciplines shows, Dog Training, Seminars, KUSA Examinations, etc. If we were to lose the grounds, it would be extremely difficult, if not impossible, to find other grounds. Goldfields Showgrounds benefit from having a history going back many, many years of holding dog shows, etc., at the grounds and hopefully it would be very difficult for local government to stop us from doing so in the future as we should have “sitting tenant” rights, but we still need adequate funds to keep things going. Unfortunately, we do not have any big sponsors and have to raise funds in every way we can. All profits from the shows are ploughed back into the grounds, contributing to the running costs and improvements (when we have the funds available). At the moment, we are building a new toilet and shower block on the bottom grounds for the benefit of the dog show community. This will cost in the region of R100 000. 

Granting this exemption would be the Kennel Union’s contribution to dogdom in Gauteng, where 70% of dogs reside, to keep Goldfields Showgrounds running for the Gauteng region. I know that this happens in Australia, where special shows run by a club maintaining its own showground are given this exemption. 

I realise that this is a most unusual request, but earnestly request you to grant this exemption, as our situation is also most unusual. 

I look forward to your favourable response to our request.” 

Exco has referred this to Fedco for a decision.

The Chairman requested the members of Fedco to express their opinion on this proposal in turn and, having assessed the comments, summed up the majority view: Causing financial prejudice to KUSA was an inappropriate and unsustainable method of raising funds and, by consenting to the request, an undesirable precedent would be created. 

The above conclusion, however, did not detract from the fact that Goldfields Showgrounds were a facility of national importance which, if lost to dogsport, would impact heavily on KUSA’s income. In view of this, the Chairman felt that Fedco should give serious consideration to a different form of accommodation and proposed that a one-off donation should be made to Goldfields Showgrounds. 

Having considered the potential value of the Show Entry Fees the Club wished to retain, the Chairman proposed an amount of the one-off donation to be R10 000,00. After further discussion, the Chairman’s counter-proposal was carried with two objections.

3.15. KUSA Participation in WODAC July 2018 
To confirm that DOGSPC and NAPC will once again take responsibility for KUSA’s presence at WODAC, if held in Gauteng, as well as the KUSA Showdog of the Year 2018 Award Ceremony. 
Budget allocation for Exhibition Stand = R30 000 
Budget allocation for Showdog of the Year framed medallions = R8 500 

The following needs were identified by Clr Robinson after WODAC 2017: 

Ÿ A person in attendance well versed in Working Disciplines and familiar with training facilities in the Johannesburg/Pretoria area. 
 A “Frequently Asked Questions” pamphlet, which would save the stall-minders time giving lengthy explanations about KUSA’s functions. 
Ÿ Literature on the National Canine Care Club (CCC), i.e. a pack (folder) containing all the elements, e.g. purpose of Club and benefits of membership pamphlet, competitions, colouring-in booklets, membership application form, etc. 
Ÿ If we are to promote the CCC on the KUSA stand, we need a portion of the stand branded and devoted to this project, staffed by a dedicated team. 
Ÿ With only one contact point behind the counter, it is simply not possible to attend to KUSA queries and haul in passers-by to engage them in a discussion about the CCC. 
Ÿ There needs to be at least two contact points on the stand, one for KUSA and another for the CCC.

In the ensuing discussion, it was noted that the event was scheduled for 20-22 July 2018 at Gallagher Estate. It was agreed, in principle, that the KUSA stand would be run by NAPC & DOGSPC.

JH, GR & CI to meet with Mr Brian Blades to discuss the terms and conditions of KUSA’s involvement in WODAC 2018.

4. MATTERS ARISING

4.1. Any Matters Related to the Articles

4.1.1. Centres – Article 13 and Schedule 3 Regulation 2.1.1 (Fedco 06-2017 item 3.11) 
Following discussion at Fedco 06-2017 on the need for Centres as currently defined in the Constitution, it was suggested that geographical provinces would be more appropriate, combined with the elimination of the ‘away point’ for Champion status. 
Work in progress. Any further information will be tabled.

Proposal accepted nem con and alterations to the Articles and Schedules in respect of reversion to geographical provinces to be finalised by CI and tabled at Fedco 06-2018 for acceptance.

4.1.2. Article 31 Classification, Registration, Recording and Transferring Ownership of Dogs 
(Housekeeping – in line with amendments made at Fedco 12-2016)

4.2. Any items Relating to Disciplinary Matters –Schedule 1 

4.2.1. Disciplinary Sub-Committee (Exco) 
The following case has been finalised and details reported to Fedco: 
Case 01-2017 – Witwatersrand Kennel Club vs Mrs CM Jacobs 
The Disciplinary Sub-Committee (DSC) met on 11.07.2017 by teleconference. The DSC unanimously found the Respondent 
guilty ito 4.1.1 and 4.1.1.2 of Schedule 1 with regard to her conduct at the Witwatersrand Kennel Club Championship Show held on 26.03.2017, where she directed foul and abusive language at a show official. Such conduct was considered to be completely untoward and unacceptable. 

The DSC imposed the following penalties, which took effect on 15 August 2017, for a period of six (6) months, three months of which were suspended. 

Rule 11.1.2: 
Suspension or exclusion from taking part in, or having any connection with, or attending or participating or handling a dog at a Show, Obedience Class, Working Trial or Field Trial or other event held under KUSA licence, or from acting as an officer of a Club; 
[NOTE: The penalty as per 11.1.2 (re attendance at shows) does not relate to the dogs in a person’s ownership, viz it applies only to Mrs Jacobs in her personal capacity and does not in any way apply to dogs that are owned and registered or recorded in her name, or owned and registered or recorded by her jointly with another or others. Such dogs may be entered and exhibited at KUSA-licensed events, provided that Mrs Jacobs is not present at the Show.] 

Rule 11.1.5: 
Disqualification from judging at, or taking part in the management of a Show, Obedience Class, Working Trial or Field Trial or other event held under a KUSA licence; 
The initial three (3) months of the above penalties shall take effect on 15.08.2017. The remaining three months will be suspended for a period of three (3) years until 14.08.2020 , on condition that the Respondent does not contravene any of the provisions as provided for in Rule 4 of Schedule 1 or any other provision in the KUSA Constitution, Rules and Regulations that would form the basis for a valid complaint in terms thereof during the period of suspension. 

No appeal was lodged.

Case 02-2017 
Following the initial notification procedure set out in Rule 7, the matter was evaluated by the SCI ito Rule 8 and, following further investigation, it was dismissed due to a lack of sufficient evidence to warrant a hearing.

Discussion ensued on the severity, or lack thereof, of penalties imposed. There was also a discussion on the Fedco ruling in respect of the penalty at Rule 11.1.2 regarding attendance at shows (see note above), in that this does not apply to the dogs in a suspended person’s registered ownership.

For each breed listed in Appendix ‘A’ of this Schedule, there shall be a written description called a Breed Standard, save and except where a single Standard has been adopted for those breeds where the varieties are [occasioned] distinguished by coat type and/or size. 2. Once adopted, a Breed Standard may not be altered or amended, save for the correction of spelling errors, conversion of measurements, or the insertion of omissions from the Standard [ of] advised by the country of origin, development or patronage, as the case may be.

Should notification be [ advised] received that a Breed Standard accepted by KUSA has been altered, or amended, save in terms of paragraph [ 2 above, by the country of origin, development or patronage, such amendments shall be tabled [ to at the next ordinary ] at the first practicable meeting of the Federal Council.

Having considered various options for the asterisked footnote to the standards of formerly docked breeds, the following wording is proposed by the Fedco members charged with drafting the footnote:

The BSD referendum closed on 04.09.2017. 59 voting papers were sent out. 16 respondents voted in favour of adopting the FCI Breed Standard. There were no votes against.

All entries shall be submitted on an official KUSA entry form, fully completed and signed. Any alteration or amendment to the Declaration thereon shall invalidate the entry. The current Form shall be that appended to this Schedule as Appendix 3. Only the current form or that immediately preceding it shall be accepted as official. 
Entries must close at the time indicated in the Schedule which shall not be less than [ fourteen 14 five (5) days and not more than [ fifty 50] thirty (30) days before the Show opens. 

Motivation: 
“At most shows these days people request to enter after the closing date that is on the Schedules. With the change of times and fewer dogs at shows and the use of the Internet and, in some cases, online entries, changes to the Regulations are required to make sure all is legal. 

We want to alter the minimum number of days which committees can choose to close entries from 14 to 5. The Clubs still have the choice to elect to close entries earlier if they so wish. By doing this, Clubs will not be contravening KUSA Regulations by accepting these entries .”

4.5.8. Schedule 3 Regulation 42 Champion Dogs - Introduction of a proposed Junior Champion in Breed 
Proposal by DOGSPC: 
Insert NEW Regulation 42.1.5 (para number to be confirmed): 
The Federal Council may award the title of Junior Merit Champion in breed to any dog on the full Breed Register of the Kennel Union or any National Canine Organisation recognised by KUSA which has won a minimum of eight (8) Best Puppy in breed and/or Best Junior in breed awards, as well as at least one Best Puppy in Group or Best Junior in Group award at Championship Shows licensed by the Kennel Union. 

Motivation: 
“A lot of exhibitors leave their Puppies and Juniors at home till they are 9 months old when the CCs start counting, and then at 18 months old when they need the final CC for KUSA Championship. A JUNIOR CHAMPION title would encourage exhibitors to bring their Puppies and Juniors out, since most shows already offer a BJIS. The show entries (and KUSA’s levies) would increase. 
For a dog or bitch between 6 – 18 months to qualify for the title of JUNIOR CHAMPION they must attain 8 x Best Puppy and/or Best Junior awards in breed and also win at least either 1 Puppy Group and/or 1 Junior Group.” 
After discussion the following was approved, with three votes against:

That the proposal be accepted subject to the title being changed to JUNIOR MERIT.

No certificate will be awarded, only the title. 
Title to be recorded on the Registration Certificate as “JM” as a Suffix.

Canine Good Citizen is not governed by a Schedule of the KUSA Constitution, but by documents setting out the Rules of each test. According to these Rules, any KUSA Judge may evaluate CGC. 

Proposal: 
In the interests of better record-keeping and assuring that Evaluators are properly contracted to do the Evaluation, it is proposed that the wording of the following paragraph in the Rules for all three (3) tests be changed by the addition of the underlined wording: 

Evaluators 
Any KUSA Judge in good standing that has been approved by a Provincial Council may evaluate KUSA Canine Good Citizen tests. There is no restriction on how often an Evaluator may conduct tests. The Evaluator may not test a dog that he/she owns or co-owns or a dog that is owned or handled by a close member of the Evaluator’s family. The Evaluator has the discretion to determine whether testing should be interrupted or postponed for whatever good reason. 
All Evaluators shall be required to complete and sign the KUSA Judging Contract – J1.

In a meeting hosted on the 20 October 2017, which included the committee of the IPO Sub-Committee and Mr John Rautenbach, the IPO National Convener, it was agreed that Schedule 5J (IPO) (2016) was in need of a revamp. The National Convener undertook to assess a number of the rules and propose changes to the Provincial Sub-Committees. In the interim, special dispensation was required in respect of the rule stating that the Helpers need to have trained a dog to IPO 1 level. It was our feeling that we were passing over very competent Helpers due to this rule, as we felt that it was not necessary to train a dog to this level to be a competent Helper. 

We request that the dispensation be granted until such time as the following proposal to change the Schedule can be tabled:

SCHEDULE 5J (IPO) (2016) – current regulation 

2. QUALIFYING OF HELPER (IPO) 
2.2. Prior to being examined, all Candidate Helpers (IPO) will have: 

ŸCompleted a training course hosted by the Tutor Helper on procedure and correctness of conduct, integrity and physical fitness what is required to become a IPO Helper and the correct execution of the exercises in trials according to regulation 5B IPO. 
Ÿhad at least one (1) year verified experience a trainee helper under a KUSA licensed IPO helper by a KUSA Active IPO Club, [and 
Ÿtrained a dog to IPO Grade I status.] 

After discussion, the following was unanimously agreed
That dispensation will be approved once the NIPOSC has submitted to KUSA its proposal to amend the rule to be placed on the Fedco 06-2018 agenda. 

Motivation: 
The NIPOSC is in the process of restructuring and overhauling the IPO Schedules to enable us to grow IPO in KUSA. In the past two years many of changes have occurred in the IPO Schedules and Bylaws in order to bring IPO in South Africa in line with the rest of the world. 

In March 2016, KUSA spent a large amount of money to bring Frans Jansen, Chairman of the FCI Utility Dog Commission, to South Africa to assist us with the qualification of Judges. The Cape Town seminar was attended by two ex-Federation Judges: 

Mr Grant Higgo, who was already a senior IPO federation Judge, qualified in 2007, before joining KUSA. His earliest history of judging at KUSA clubs was on the 30/08/2014 when he judged the Bouvier des Flandres Club Gold Reef. His earliest history as Helper at KUSA events was at the Meisterschaft in 1999 in Kwa-Zulu-Natal, and then in 25/08/2012 when he was the Helper at the WP Rottweiler Club IPO event. 

Mr Jean-Luc Stapelberg, who qualified as a KUSA Judge on the 27/03/2016 and as a KUSA Helper on the 28/02/2014. Mr Stapelberg has been a Federation Helper from 1994 and has officiated on many occasions as Helper at KUSA events, i.e. Meisterschaft 2013 in Gauteng and as Helper in the qualification of KUSA Helpers in Cape Town on the 20/10/2008. He has also been the Helper on a regular basis at Rottweiler breed events in Cape Town. He has been a Federation Judge since 2012. 

Both gentlemen have a long history of involvement with KUSA events and the NIPOSC requests that their experience obtained in the GSDFSA before the termination of the KUSA/GSDFSA agreement be recognised: 
Mr Higgo - Schedule 5J 3.1.1 and 5B IPO 3.6.16. 
Mr Stapelberg - Schedule 5J 3.1.1

3. QUALIFICATION OF TUTOR HELPERS (IPO) 
3.1 Before any person can be apply to be placed on the panel of Tutor Helpers (IPO) he must have: 

3.1.1 five (5) years’ experience, verified by a KUSA IPO Active club, in training IPO of which at least 3 years must be as a KUSA Registered Helper. 

After discussion, the following was unanimously agreed

That dispensation be granted to Mr Jean-Luc Stapelberg and Mr Grant Higgo under Schedule 5J Regulation 3.1.1.1, as requested, subject to a statement being obtained from a KUSA IPO Active Club in training IPO, verifying that Mr Stapelberg & Mr. Higgo were currently training with them as a KUSA Registered Helper. 

SCHEDULE 5B (02) – current regulation 

3.6.16 Qualification of International IPO Judges 
To be recognised by the FCI as an international IPO performance Judge, the applicant must meet the following minimum requirements: 

1. Minimum age: having reached the South African legal capacity. 
2. At the time of the application he must have qualified at least two dogs to the highest test level - IPO 3 
3. Have judged, or entered a dog successfully at a national or international championship level 
4. The applicant must be appointed by his FCI-Local Organisation (KUSA); he must have passed National IPO Subcommittee reviews. 

The candidate must have: 
a) In-depth knowledge of the rules is one of the most important factors in assessing and qualified a IPO performance judge. He must know the FCI Working Dog Rules in their entirety and must be confident with each department, to be able to assess and make the right decisions 
b) The practical training must enable the applicant to acquire complete knowledge of all provisions, as well as scenarios that may occur on the working field. 

The practical training consists of the successful Judging of at least 10 competitions, in which the candidate gains confidence. This is a prerequisite for the written examination. 

With regard to the request for dispensation for Mr Higgo under Schedule 5B IPO Regulation 3.6.16, more clarity was required, since International IPO Judges were recognised by the FCI and needed to meet the FCI’s rules and regulations.

Each Handler will be required to handle all four (4) new exhibits, subject to the provisions of 8.6. after which each of the four (4) shortlisted Handlers will each be required to handle two (2) new exhibits, chosen by the Judges, from a list of breeds provided by the organisers, subject to the provisions of 8.6. In the final round, each of the four (4) shortlisted Handlers will be required to handle two (2) exhibits from a pool of dogs provided by the organisers. The organisers will provide the Judge(s) with a list of the breeds of dog in the pool and the Judge(s) will select which two breeds each finalist will handle. Each dog in the pool may not be allocated to more than two (2) Handlers. Handlers will be allowed five (5) minutes with each of their allocated dogs prior to the start of the final round and will enter the ring in draw order.

SABOX Breed Assessment & Survey Procedures

3 ELIGIBILITY 
3.1 To be eligible for entry in a breed survey or breed assessment, a Boxer must: 
 be registered in the KUSA Breed Register; 
Ÿ be at least 15 months old on the day of the evaluation; 
Ÿ be healthy and in good condition; 
Ÿ be positively identifiable by means of a microchip, DNA or tattoo; 
Ÿ have been examined and certified for hip dysplasia and conform to the requirements as set out by SABOX from time to time; 
Ÿ have been examined and certified for cardiac disorders and conform to the requirements as set out by SABOX from time to time; 
Ÿ if a male, have two apparently normal testicles fully descended into the scrotum. 

Motivation: 

Subaortic/Aortic & Pulmonic Stenosis (SAS/AS/PS) are amongst the most common heart defects occurring in Boxers. Screening tests: Auscultation (stethoscopic examination) for heart murmurs, colour doppler echocardiography. 
According to the Orthopaedic Foundation for Animals (OFA) in the USA, while there are exceptions, virtually all common congenital heart defects are associated with the presence of a cardiac murmur. This includes aortic and pulmonic stenosis.

Consequently, it is recommended by the OFA that cardiac auscultation be the primary screening method for initial identification of congenital heart defects and the initial classification of dogs. Should a murmur be detected, this should then be followed by an echo-doppler examination to determine the exact cause. 
The British and Australian Heart Murmur Schemes for Boxers are similar and also based on initial screening by means of auscultation. 
SABOX therefore agreed unanimously that examination and certification be made a requirement for eligibility for entry in a SABOX breed survey/breed assessment.

6.2.3. Amendments to SABOX Constitution

Submitted by SABOX

Clause 8.2:

Whenever a new Boxer Club is affiliated to KUSA, its membership of SABOX shall commence from the date that its affiliation has been accepted by the Federal Council of KUSA, in terms of Article 8 of the KUSA Constitution and no other formality shall be required to obtain and retain membership [ other than that its committee at all times shall comprise of members 80% of which are past or present Boxer owners ].

Motivation: 
Unless we remove the portion in brackets, the SABOX affiliation of Natal Boxer Club could be in jeopardy as it has some committee members active in agility, not all of whom owned Boxers.

Clause 15.3.6:

At the first meeting held by SABOX in each alternate financial year, the members of SABOX shall from their number elect a Chairman and a Vice Chairman who shall hold office for two years, always provided that in the event of either office bearer being unable to continue to act in such capacity during the course of his term of office, members of SABOX may elect from their number a replacement.

If at any meeting of SABOX during their two-year term of office, the Chairman and Vice Chairman are not nominated Representatives of Member Clubs, they will be entitled to attend such meeting ex officio, but shall not be entitled to a deliberative vote. The Chairman shall however be entitled at such a meeting to exercise a single casting vote in the event of the total votes cast being equally divided between those in favour of the motion and those against such motion.

Clause 15.3.7:

SABOX shall appoint a Secretary of SABOX who need not be a Representative and the Secretary shall hold appointment for such period of time as SABOX may decide. In addition to a Secretary, SABOX may appoint a Treasurer who need not be a Representative and the Treasurer shall hold appointment for such a period of time as SABOX may decide.

The Secretary and Treasurer will be entitled to attend any meeting of SABOX ex officio, but unless they are nominated Representatives of Member Clubs, they will not be entitled to vote.

Motivation: To ensure the right to equal representation of all Member Clubs at all SABOX meetings, it should be stated unequivocally in the SABOX Constitution that ONLY nominated Club Representatives should be able to vote.

6.2.4. Adoption of FCI Breed Standard No 144 
Proposal: 
In accordance with the minutes of the Fedco 06-2017, items 4.4.1.1.1 & 4.4.1.1.13 relating to the Tail Clauses in FCI Breed Standards, SABOX proposes that the FCI Breed Standard be accepted as the recognised Breed Standard for the Boxer breed in South Africa, provided that the proposal regarding the amendment to be carried forward under item 4.4.1.1.1 of the Minutes of Fedco 06-2017 be accepted at Fedco 12-2017.

Motivation:

The SABOX stance regarding tail docking has always been, and still is, that breeders and owners of KUSA-registered Boxers should be free to decide whether to dock, or not, and that neither docked nor undocked tails should be discriminated against. When the FCI standard was changed to no longer accommodate docked as well as undocked tails, it was decided two years ago to revert to The Kennel Club Breed Standard for Boxers which describes both docked and undocked tails. 
Since changing their standard to only accommodate “natural tails” in line with the laws of Germany, the FCI has issued Circular 8/2016, which directs, in essence, that in countries where there is no restriction on the showing of docked/cropped dogs (unlike in Germany), there may be no discrimination by judges between docked and undocked, or cropped and uncropped, dogs. 
Therefore, if the above proposal regarding the standards of formerly docked breeds is approved and implemented by KUSA, the principal reason for SABOX’s recommendation to Fedco to adopt The Kennel Club standard will no longer exist and it was agreed by SABOX to again accept the FCI standard.

6.3.2. Registration – German Shepherd Dogs (Fedco 12-2016 & Fedco 12-2015) 
Fedco approved a proposal to legitimise German Shepherd Dog registrations within KUSA (NCO of FCI in RSA) and interested parties were to be given until 31.12.2016 to submit registrations and apply for current Kennel Names, after which the current KUSA regulations for registrations would apply.

Agreed unanimously to extend the grace period for a further year until 31.12.2017. 
Agreed unanimously to extend the grace period until 31 May 2018 to align with the termination date of the FCI-WUSV agreement. 

6.3.3. Workbooks/Record Cards – German Shepherd Dogs (Fedco 06-2016) 
Fedco further agreed unanimously to grant dispensation to allow the rectification of Record Cards/Workbooks under the above criteria until 31 December 2017, after which date the current KUSA rules and regulations for Record Cards/Workbooks shall apply. 
Agreed unanimously to extend the grace period until 31 May 2018 to align with the termination date of the FCI-WUSV agreement.

7. MATTERS BROUGHT FORWARD BY THE CHAIRMAN 

7.1. Establishment of a Judges Education Council (JEC) 
It has been five years since the introduction of the KUSA Breed Judges’ Learning Programme and deemed an appropriate time for Fedco to reflect on the Programme’s efficacy as a method of educating and training Breed Judges and, more importantly, to consider whether the interests of the Programme were optimally served by the provincial-based administrative structure, modelled on the structure devised for Working Disciplines Sub-Committees. 

Fedco concluded that, given the changes witnessed in the dog-showing landscape over the past five years, and the rapidly evolving demographics, the Programme needed to keep pace in order to remain effective and relevant. Fedco further concluded that, in order to appropriately respond to dog-showing dynamics, the Programme needed to be underpinned by an administrative system that was lean, agile and nationally based. 

After deliberation, and with input from all the Federal Councillors, it was unanimously resolved to establish a sui generis Council in terms of Article 3.11 of the KUSA Constitution. The members of the Council will be appointed by Fedco and comprise persons with specific skills and expertise. Reporting directly to Fedco, the Council will be known as the Judges Education Council (JEC), functioning under its own Constitution, with a broad mandate ultimately to oversee judges’ education across all Disciplines and to develop KUSA’s policies, codes and guidelines pertaining to its Learner and Licensed Judges. 

Fedco adopted the provisional Constitution for the JEC and authorised GR & JH, the current portfolio-holders for Judges’ Education, to make such refinements to the Constitution and to the organisational structure of the JEC as they deemed appropriate. 

Fedco debated the merits of the inaugural meeting of the JEC being face-to-face and resolved that this would be desirable and that an appropriate budget needed to be made available, utilising the funds earmarked for the disbanded NBJSC. 

 7.2. Establishment of the Federation of Boxer Clubs of Southern Africa Breed Council (FBCSA BC), uniting the existing Federation of Boxer Clubs of Southern Africa (FBCSA) and the South African Boxer Breed Council (SABOX) under KUSA 

JH and GR reported to the Federal Council: 

Following protracted negotiations between the Executive of the FBCSA and a KUSA Task Team comprising JH and GR, a decision has been reached on the reunification of the Boxer breed. The FBCSA declared its intention to wind up its operations to function independently as the registered Breeders’ Society and Registering Authority for Boxers under the Animal Improvement Act (AIA) and be established as a Breed Council under KUSA, replacing SABOX as from 1 April 2018. Since the FBCSA is, and will remain, the legally registered Breeders’ Society for Boxers under the AIA, the new structure will be called the Federation of Boxer Clubs of Southern Africa Breed Council (FBCSA BC). 

As per the negotiated arrangement, the FBCSA will give notice to SA Studbook that the latter’s services as the FBCSA’s delegated Registering Authority for Boxers will terminate on 31 March 2018. On 1 April 2018, KUSA will officially become the delegated Registering Authority of the Breeders’ Society to handle and process the future registrations of Boxers. 

The FBCSA-affiliated clubs will affiliate to KUSA, joining the existing KUSA-affiliated Boxer clubs as partners in the new Breed Council. Prior to the effective date of the new Breed Council, the KUSA clubs and the former FBCSA clubs will adopt uniform Club Constitutions, which will be in harmony with the Constitution of the FBCSA BC. 

In the interests of a seamless transition, and in deference to the FBCSA’s status as the Breeders’ Society, the representation on the FBCSA BC will, for the initial term of two years plus the unexpired term of the current financial year, be (named) club-agnostic. The FBCSA BC will comprise eight Representatives, four from the ranks of the KUSA Boxer fraternity and four from the ranks of the former FBCSA Boxer fraternity. For the period in question, the eight Representatives will serve under the chairmanship of an appointee from the ranks of the former FBCSA Boxer fraternity. 

ŸThe establishment of the FBCSA BC under KUSA on the envisaged date of 1 April 2018 is hereby approved.

The proposed new uniform Constitution for former FBCSA-affiliated clubs and KUSA-affiliated Boxer clubs is hereby approved
ŸThe adoption of the new Club Constitution by all the KUSA-affiliated Boxer clubs within the negotiated timeframe (to be confirmed by the KUSA Task Team) is hereby directed
ŸThe adoption of the new FBCSA BC Constitution by the four elected Representatives of the KUSA Boxer fraternity within the negotiated timeframe (to be advised by the KUSA Task Team) is hereby directed
ŸAs far as the appointment of the Representatives from the KUSA Boxer fraternity is concerned, it is recommended that serious consideration be given to regional inclusivity. 

It was accepted by Fedco that the two Constitutions in question might be requisite of minor amendment prior to their adoption. Having regard for the Club Constitutions’ uniformity, the approval of such minor amendments were entrusted to the discretion of JH & GR. 

7.3. SAVA/KUSA HD & ED Scheme 
Having surveyed the clubs for breeds that routinely screen for HD, ED, or both, it became apparent that the new scheme proposed by SAVA was unacceptable to the majority of KUSA stakeholders. 

Fedco directed PM to inform SAVA that, unless it was able to devise a scheme with greater appeal, KUSA would elect to remain with the current scheme. This course of action was unanimously approved

PM enquired about the destiny of the journal article received from Prof Robert Kirberger which, unfortunately, arrived too late for inclusion on Fedco Agenda. The Chairman requested Clrs Hubbard and Robinson to consider the article and for possible dissemination to targeted recipients. 

7.4. Introduction of DNA Profiling (Fedco 06-2017) 

In accordance with international practice, mandatory DNA profiling should be introduced for imported and exported dogs. An amendment to Schedule 2 is to be prepared for the agenda of Fedco 12-2017. With regard to the introduction of DNA profiling for dogs registered in the KUSA area of jurisdiction, breeders should, in the meantime, be encouraged to do this on a voluntary basis. It was suggested that Dr Cindy Harper of the Onderstepoort Veterinary Genetic Laboratory be requested to write an article on the current trends, merits and benefits of DNA profiling. It was further suggested that additional information should be obtained in respect of DNA profiling from imported frozen semen.

After discussion it was agreed that, to commence the process, DNA profiling will become a requirement for the issue of a Show Clearance Certificate or Registration Certificate of imported dogs and for the issue of a three-generation Certified Export Pedigree.

All imported dogs must be micro-chipped and have a standardised international marker DNA profile before acceptance for registration on any KUSA register.

In the case of a mating having taken place in any country, the Canine Control Body of which is in reciprocity with or recognised by the Kennel Union, a separate mating certificate signed by the owner of the sire, veterinarian and any witness to the mating in the country of origin will be acceptable, if fully completed with the essential details of the dog (including microchip number and standardised international marker DNA profile ) [and], details of the bitch and the dates of mating [and otherwise in order]. In such cases the name of the owner(s) of the sire must coincide with the registered ownership certificate issued by the foreign canine control body.

7.5. 2nd Championship Shows Surveys 

The Chairman noted that some Provcos had conducted surveys on the 2 nd Championship Show and enquired whether these had rendered definitive results. The answer was a universal “no” but, broadly speaking, the following conclusions could be drawn from the exercise: 

7.5.1. Exco should continue awarding 2nd Championship Show licences to clubs that request them. 

7.5.2. The criteria applied for the awarding of 2nd Championship Shows should be more stringent, for instance, it should be conditional on the holding of a Non-Championship Show and on compliance with the club’s undertakings in the previous year. 

7.5.3. The criteria should be more leniently applied in non-populous areas, i.e. to the clubs of the FS&NCPC and EC&BPC. 

The opposition of two Federal Councillors to the holding of a Non-Championship Show being considered as a condition for the awarding of a 2nd Championship Show licence in any area was noted. 

After further discussion it was concluded that it was not possible to set hard and fast criteria for the awarding of 2ndChampionship Show licences. Each case needed to be assessed on its own merits, taking the above points into account, but also exercising sound judgment with regard to the possible impact on other shows around the country. Applications for 2nd Championship Shows should be subject to much closer scrutiny in future and the appeal to Exco is to exercise its discretionary powers in this regard with prudence and circumspection. 

7.6. Grand Champion points earned at Specialist Clubs for a Breed with Multiple Varieties, considered to be separate breeds for purposes of Exhibition and Awards 
After discussion, it was unanimously resolved that the definition of Specialist Club needed to be amended to provide for Grand Champion points earned at Specialist Clubs catering for breeds with multiple varieties. 

CI was charged with drafting a suitable proposal for the Agenda of Fedco 06-2018. 

7.7. Schedule 3 Regulations 14 & 19.8 – Exclusion of Dogs and Reporting Dog Aggression incidents at Shows. 
The new form devised for reporting of dog-biting incidents at shows was tabled and unanimously approved for immediate implementation. 

It was noted that certain amendments were required to Schedule 3 Regulations 14 and 19.8 and Exco was charged with the drafting of a suitable proposal for the Agenda of Fedco 06-2018. 

7.8. Show Entry Fees (Levies) charged by KUSA for Qualifying Shows 
Since no awards were offered at Qualifying Shows, dissatisfaction had been expressed that Show Entry Fees charged by KUSA for Qualifying Shows were on a par with those charged for Championship Shows. 

There was unanimous agreement that the Show Entry Fees for Qualifying Shows should be lowered to 50% of those charged for Championship Shows and that item 15.3 of the Subscription & Fees document issued pursuant to Schedule 7 should be adjusted to reflect the fee payable as R10.00 instead of R20.00.

7.9. Disaffiliation of Clubs in default of Articles 9.1.3 and 9.1.4. of KUSA Constitution 
At Fedco 12-2015 the following was decided: 
It was confirmed that any Club which had not submitted documents for three years will be recommended for disaffiliation at Fedco’s discretion. 

This period was considered to be too lenient, since it served as no deterrent to continuous default. 

After consideration, it was unanimously resolved to reduce the period to eighteen (18) months, commencing on the date of the Fedco meeting where the default was tabled. This means that Clubs that fail to comply with the provisions of Articles 9.1.3 and 9.1.4 for a period of eighteen months from the Fedco meeting where the breach was reported, will be recommended for disaffiliation. 

7.10. FCI Award Certificate 

The newly designed multi-purpose FCI Award Certificate providing for Awards on the reverse was tabled by CI. 

7.11. Membership of KUSA for Chairmen and Vice-Chairmen of Clubs 

The Constitutions of certain Provcos provide that the official representative of a member Club on the Council will automatically be the Chairman of that Club, unless the Chairman is also the chairman of another Club which he/she represents, in which case the official representative will be the Vice-Chairman of the Club. Provco Constitutions further provide that all Club representatives, whether they serve as Representatives or Alternates, must be members of the KUSA which, by implication, means that the Chairman and the Vice-Chairman of Clubs need to be members. 

It makes no sense that the Provco Constitutions require the Chairman and Vice-Chairman of a Club, either acting as the Club’s representative on the Council, to be members of the KUSA, yet the KUSA Constitution is silent on such requirement. Moreover, how can the two top executives in a Club be required to encourage and enforce compliance with the KUSA Constitution by others, yet they are not themselves members of KUSA? 

A further factor is that every member of the Provcos’ Sub-Committees is required to be a member of KUSA. Why should an ordinary member of a Sub-Committee be obliged to acquire KUSA membership, when there is no such obligation on a Chairman and Vice-Chairman of a Club? 

Since the Articles were out of sync with certain Provco Constitutions, it was necessary, as a matter of housekeeping, for Article 8.6.2 to be amended as follows:

8.6.2 details of every Annual General Meeting and any other Special General Meeting specifying the names of persons present and resolutions adopted, together with one copy of the annual audited accounts of income and expenditure and the Club’s balance sheet shall be forwarded to the Federal Council. Minutes of Annual/Special General meetings shall be supplied within thirty (30) days of any such meeting and the copy of the audited accounts shall be supplied once in each calendar year. The Club shall ensure that the Club officials[‘] (Chairman, Vice-Chairman, Secretary and Treasurer) names and contact details shall be[are] sent to KUSA for recording each time there is a change and shall further ensure that the Chairman and Vice-Chairman are members in good standing of the Kennel Union

7.12. Natural Bobtail – Endorsement of Pedigrees 

At Exco 09-2017, the following was agreed: 
Upon receipt of a veterinary certificate, which includes the microchip number of the dog, attesting that the dog is a natural bobtail, this information will be placed on the Certificate of Registration under ‘Notations’. 

The above Exco directive was unanimously approved and it was agreed to place a Notice on the KUSA website as requested by Exco. 

7.13. Regulating the judging of the Final (In-Show) Challenges at All-Breeds Championship Shows 
It has become increasingly common at All-Breeds Championship Shows for dogs awarded top honours (Best in Show) being beaten by another dog in a secondary In-Show Challenge. The concept of a beaten dog winning Best in Show, although not prohibited under any KUSA regulation, sticks in the throat of purists who never fail to point out that South Africa must be the only country in the world where such a practice was tolerated. Of late, there have been repeated calls from seasoned exhibitors for KUSA to “legislate” against such a scenario playing out. 

Although it has happened that a judge officiating for all the In-Show Challenges either loses his/her way, or changes his/her mind, the scenario of a beaten dog winning Best in Show normally plays out where the judging of the In-Show Challenges is spread out among the panel of judges. 

To substantially reduce the risk of beaten dogs winning Best in Show, it was unanimously agreed that a proposal should be drafted for the Agenda of Fedco 06-2018 to regulate that all In-Show Challenges at All-Breeds Championship Shows shall be judged by the same judge. 

7.14. Number of placings in Final (In-Show) Challenges 

At some shows four dogs are placed in the In-Show Challenges. Being placed 3rd or 4th best in a Final Challenge is a meaningless accomplishment and it is most unpleasant for In-Show judges to dismiss three unplaced dogs from the ring to go and figure out which dog would have been placed 5th, 6th and last. It is far preferable to place a Winner and a Reserve and be left with five dogs unplaced. 

Fedco was united in the view that the practice by some clubs to expect four dogs to be placed in their In-Show Challenges was nonsensical and that the only way to spare judges the frustration, and exhibitors the embarrassment, caused by this unnecessary praxis would be to regulate against it. 

It was unanimously agreed that a proposal should be drafted for the Agenda of Fedco 06-2018 to regulate that only two (2) dogs should be placed in all In-Show Challenges at Championship Shows. 

7.15. Colours not Recognised 

At Fedco 12-2012, it was decided that the notation “Colour not KUSA-recognised” would appear on the Registration Certificate of a dog if the colour on the registration application does not match any of the colours listed in the Breed Standard of the breed in question. 

The KUSA office required guidance on double-checking, in cases of doubt, before appending the notation “Colour not KUSA-recognised” and it was decided that such cases ought to be referred to LW. The alternative was to approach Specialist Clubs with a request for a list of recognised colours for their breeds for use by the KUSA Office. 

The problem of legacy data was also considered, i.e the correct and incorrect colours recorded on Registration Certificates over the years. Fedco was unanimous in the view that stricter control over the colours cited on Registration Certificates was a prospective procedure and that nothing could be done about incorrect legacy data. 

The possibility of the recording the colours of all the dogs on a Registration Certificate in future was confirmed by PM and unanimously approved by Fedco. 

7.16. Affiliation Fees – Championship Show-holding Dog Training Clubs 
In the current economic climate, Championship Show-holding Dog Training Clubs were finding it increasingly difficult to sustain themselves and appealed to Fedco to review their annual Affiliation Fees. 

It was noted that Championship Show-holding Dog Training Clubs paid an Affiliation Fee that was only slightly lower than that of Championship Show-holding All-Breeds Clubs and Fedco conceded that the historical reasons for the relatively high Affiliation Fee paid by Dog Training Clubs were no longer valid. 

It was unanimously approved that the Affiliation Fee for Championship Show-holding Dog Training Clubs must be reduced to be on a par with that charged for Championship Show-holding Specialist Breed Clubs and Specialist Disciplines Clubs. Item 13.2.5 of the Subscription & Fees document issued pursuant to Schedule 7 must be adjusted to reflect the fee payable as R748.00.

7.17. Tax Exemption – Public Benefit Organisations (PBOs) 
On 12 October 2017, PM circulated the following letter to Clubs after certain Clubs had received reminders from SARS to submit their Tax Returns: 

“Clubs are reminded that they are required to submit a Tax Return (IT12EI) and Financial Statements to the South African Revenue Services (SARS) on an annual basis, even if they have been granted tax exemption by the SARS Tax Exemption Unit (TEU). In 2007 there was a change to the law governing taxation of recreational clubs, whereby recreational clubs became subject to a system of partial taxation, as opposed to automatic full exemption. 

Attached, please find an article written by Professor Matthew Lester in 2007 explaining the reasons for the changes. Clubs were given a transitional period until the 30 September 2010, in order to apply for partial exemption in terms of the provisions of Section 30A (4) of the Income Tax Act of 1962. 

According to the Basic Guide to Tax Exemption for Public Benefit Organisations (PBOs), the mere fact that an organisation has a non-profit motive or is established or registered as an NPO under the NPO Act, or is established as an Not-for-Profit Company (NPC), does not mean that it automatically qualifies for preferential tax treatment, or approval as a PBO. An organisation will enjoy preferential tax treatment only after it has applied for, and been granted, approval as a PBO by the Commissioner, and continues to comply with the relevant prescribed requirements . For further information, please refer to the attached guide which may be downloaded from the SARS website. The link to the Tax Exempt Organisation page on the SARS website ishttp://www.sars.gov.za/ClientSegments/Businesses/TEO/Pages/default.aspx. Tax returns can be sent via: eFiling (to make your submission electronically, register on www.sarsefiling.co.za ); Any SARS branch; Post to the TEU or a SARS branch. Photocopies/faxed copies of the IT12EI are not accepted by SARS. 

We urge you to ensure that your club complies with the tax laws that govern recreational clubs.” 

It was noted that some Clubs have expressed the view that the filing of Clubs’ Tax Returns was the responsibility of KUSA and not that of the Clubs. Following discussion, Fedco confirmed that, as a Voluntary Organisation, KUSA was subject to different Tax obligations. Clubs were autonomous Public Benefit Organisations, regulated separately under the Income Tax Act. 

Fedco unanimously confirmed that PM had advised Clubs appropriately and that Tax compliance was the responsibility of the individual Clubs. 

7.18. FCI Shows – Per Dog CACIB Fee in addition to KUSA Show Entry Fee 
It was noted that some Clubs felt disgruntled about the so-called “double levy” on entries for an FCI Show, which was difficult to understand when this has been standard practice since FCI Shows were introduced to South Africa. It would appear that those complaining failed to familiarise themselves with the terms and conditions applicable to International Shows, prior to applying for an FCI Show licence. 

Fedco confirmed that a per dog CACIB Fee, currently €1.40, was payable in addition to the KUSA Show Entry Fee for every dog entered and it was unanimously agreed that the per dog CACIB Fee would in future be reflected in Euros in the Subscription & Fees document issued pursuant to Schedule 7. 

7.19. Revision and harmonisation of Provincial Councils’ Constitutions 
The manner in which the various Provco Constitutions have evolved over the years has led to major discrepancies between them. Some Provincial Councils were subject to stricter regulation than others and some Constitutions lacked certain fundamental provisions pertaining of responsible governance. 

Since Provincial Councils operate under powers delegated to them by the Fedco, it was necessary that all Provincial Councils operated under Constitutions which were not only in harmony with the KUSA Constitution, but also in harmony with each other with regard to the rights conferred, and the obligations imposed, on Council members. 

Fedco unanimously agreed that the Chairman should appoint a team to undertake the task of reviewing and harmonising the Provincial Council Constitutions. The following persons were appointed: GR, LW and CB. 

7.20. By-laws of Provincial Council Sub-Committees 
It was unanimously agreed by Fedco that the By-laws of the Provincial Council Sub-Committees were also in need of harmonisation and, since they form Appendices to the Provco Constitutions, it was further unanimously directedthat the task of the revision and harmonisation of the Provincial Council By-laws should also fall to the team charged with the revision of the Provco Constitutions. 

7.21. Neapolitan Mastiff – Change of Breed Standard from Kennel Club to FCI 
It was noted that a prominent breeder of Neapolitan Mastiffs had requested a breed standard change and it was unanimously agreed that a referendum should be done using the same criteria as those applied to the recent Belgian Shepherd Dog referendum.

7.22. South African Sheepdog Association (SASDA) 
PM advised the Council of the previous arrangements made with SASDA regarding registrations. Fedco confirmed the continuance of the arrangement.

7.23. Duties of a Club Show Manager 
GR informed the meeting that he had not yet had time to review the document tabled by DP and JB at Fedco 06-2017. He did, however, feel that the document should rather be subjected to the scrutiny of an experienced Show Manager. 

JH informed the meeting that she might be able to convince a Show Manager of many years’ experience to peruse the document and give input. 

Fedco thought this to be the appropriate course of action and it was unanimously agreed that JH should use her best efforts to secure the consulting services of the person she had in mind.
