THE KENNEL UNION OF SOUTHERN AFRICA MINUTES OF A MEETING OF THE EXECUTIVE COMMITTEE OF KUSA HELD AT 13H00 ON TUESDAY 24TH MARCH 2020 BY TELECONFERENCE

1. ATTENDANCE, APOLOGIES & ANNOUNCEMENTS

The following recent death was noted with sadness - nil

BJ welcomed everyone with special word of welcome to Mr Griffith who joined the meeting as an observer.

2. MINUTES

The Minutes of the meeting held on 21.02.2020 were formally adopted.

3. ANY MATTERS ARISING FROM PREVIOUS MINUTES

3.1 SA Dog Show Manager (Pty) Ltd (Exco 10-19 item 10.2, Exco 11-19 item 3.3, Exco 02-20 item 3.1)

Follow-up on outstanding monies owed to Clubs.

It was suggested that criminal charges be laid by Clubs concerned.

Work in progress. NdP to assist Clubs with wording for Affidavits.

3.2 Protection of KUSA Trademark – Registration with CIPC (Exco 01-2020 item 10.2, Exco 02-2020 item 3.3)

Work in progress. Delayed due to COVID-19 contingency plans taking priority.

3.3 Supervision of Children at Dog Shows (Exco 02-2020 item 10.1)

At the request of NdP, BJ reported that an amendment is to be made to Schedules 3 and 4 to make it a requirement that underage children must be under the supervision of a parent or responsible adult while attending Dog Shows.

The appropriate wording is to be formulated by NdP for the Fedco Agenda.

4. KUSA OFFICE

4.1 Office Report

After discussion the Office Report was approved.

Letter drafted by NdP to be sent to a Member who had contravened the Code of Ethics (Members’ Advert)

4.2 Finance

After discussion, the Financial Reports for February 2020 were approved.

5. SUB-COMMITTEES

5.1 DISCIPLINARY SUB-COMMITTEE

5.1.1 DSC Workshop (Exco 01-2020 item 5.1.2 Exco 02-20 Item 5.1.2)

NdP recommended that a Workshop be held on the process and procedures of Schedule 1.

Arrangements for a special telecon to be discussed with NdP.

5.2 SHOWS

5.2.1 Applications for Second Championship Shows – Nil

5.2.2 Schedule 3 Regulations 5 - Show Schedules - Reg 16 ( Exco 06-2019), (Exco 07-2019), (Exco 08-2019), (Exco 09-2019), (Exco 10-19), (Exco 11-19), (Exco 01-2020)

A list was not tabled due to Adele Bastick being on sick leave and the changes of circumstances due to the COVID-19 outbreak.

5.2.3 Schedule 3 Reg 14 – Exclusion of Dogs & Reg 19.8

5.2.3.1 Temporary Exclusion Order (TEO) (Exco 01-2020 item 5.2.3.1, Exco 02-2020 Item 5.2.3.1)

At Fedco 12-2019, it was agreed that an alternate procedure needed to be devised by Exco for dealing with Dog Aggression, preferably in consultation with accredited Animal Behaviour Consultants.

The procedure should not only apply to Breed dogs, but also to dogs competing in Working Disciplines.

Revised TEO Procedure circulated by BJ on 11.03.2020.

After discussion it was decided that the Public Liability aspect needs to be researched and possibly included. Judges to be made aware that they are not covered by the KUSA Public Liability Policy. Judges’

Contract may require amendment. NdP to revert to Exco.

5.2.3.2 Temporary Exclusion Order (TEO) – Ch Ilruca Deyzel – Boxer - Reg No: ZA015834B11. (Exco 01-2020 item 5.2.3.2, Exco 02-2020 Item 5.2.3.2)

TEO issued 12.12.2019, following a biting incident at the Jacaranda City Kennel Club Show held on 24.11.19.

No reply has been received to date.

Noted.

5.2.3.3 Temporary Exclusion Order (TEO) – Mardusmara Maveric – Boxer - Reg No ZA002841B19 (Exco 01- 2020 – item 5.2.3.4, Exco 02-2020 Item 5.2.3.3)

TEO issued on 13.11.2019 following incident at Western Province Kennel Club Championship Show held

on 27.10.2019.

Reply received and circulated on 27.01.2020. Exco confirmed the decision that the Boxer should successfully undergo a CGC (Bronze) and then be examined by three Judges.

The Chairman of the WCPC Obedience Sub-Committee has been in contact with the owner regarding CGC arrangements.

No further information received as yet.

5.2.3.4 Temporary Exclusion Order (TEO) – Highleigh Midnight Pepper - Pembroke Welsh Corgi – NAPC Top Dog (Exco 02-2020 Item 5.2.3.5)

TEO issued 27.01.2020 to Pembroke Welsh Corgi Highleigh Midnight Pepper Dog exhibit no 216, ZA011098B19, Microchip No 953010003507909 (owned by Mrs DA Darroll and Miss MA Cole) for showing aggression to the Judge, resulting in the Corgi being excused from the ring.

Info circulated to Exco on 27.01.2020.

Any response from the owners will be tabled.

No response.

5.2.3.5 Temporary Exclusion Order (TEO) – Boxer - Dawkendale Ace’s High – Liesbeek Kennel Club Non- Championship Show held 02.02.2020 (Exco 02-30 Item 5.2.3.6)

TEO issued on 13.02.2020 following incident at the above Show where the Boxer pulled away from his handler/owner and attacked a Bullmastiff that was walking nearby with his handler.

Although the owner of the dog was asked to submit a response for the March Exco, a communication was received just prior to the February Exco and circulated. Time did not permit thorough consideration of the contents and it was decided to defer the matter to this meeting, when NdP will be available for guidance.

After discussion, it was decided that the TEO is to remain in place until all requirements for the lifting of the

TEO are met.

5.2.3.6 Temporary Exclusion Order (TEO) – Bull Terrrier – Ferrorok Rosebelle of Herdre – SA Bull Terrier Club (Major Trophy Show) held 01.02.2020

TEO issued on 02.03.2020 to Bull Terrier - Ferrorok Rosebelle of Herdre Reg No ZA003309B16 for showing aggression to the Judge resulting in the Bull Terrier being excused from the ring.

Info circulated to Exco on 02.03.2020.

No response received.

5.2.4 OTHER CLUB / SHOW MATTERS

Show postponements and cancellations due to the COVID-19 outbreak will be published on the KUSA website. NdP advises that Clubs may not withhold portions of refund payments to defer costs incurred by the Club unless such provision is recorded on the Show Schedule. It was suggested that Clubs be informed of their legal obligations via a letter circulated by Provincial Council Secretaries. NdP recommends that going forward a clause be included in Show Schedules with regards to Show cancellations and the refund of entry fees paid.

5.2.5 KUSA Classic

5.2.5.1 2020 Gauteng – Nationals Agility, Dog Jumping, Flyball, FCI CACIAG (Agility) Show – 26.04.2020

To be held in conjunction with NAPC Bumper Weekend. In response to a request for the budget:

“The Bumper Weekend Committee, which is hosting these nationals, is aiming to break even. It sponsors the Nationals to a large degree and if something has to be paid towards the International Judge, then this must be accommodated in the Classic Weekend Budget.”

5.2.5.2 2020 Gauteng – Nationals Breed FCI CACIB Show, Obedience, Carting and Handling

To be held Thu 28 May to Sun 31 May 2020.

(Incorporating KUSA Championship Show/KUSA Winners (Breed), Obedience, Carting, Agility, Dog Jumping and Flyball.)

2020 KUSA Classic Breed.

Budget requested and circulated on 18.03.2020.

Show postponed.

5.2.5.3 2020 Gauteng – KUSA Nationals and Championship Shows – WT (Classic), WUD

To be held Sat 20 June and Sun 21 June 2020.

Budget received and approved by the KCCT.

5.2.5.4 2020 Western Cape – KUSA Annual Event IGP Meisterschaft - 29-31 May 2020

Show postponed.

5.2.5.5 2021 KUSA Classic - 28-30 May 2021 (Exco 01-2020 item 5.2.5.4)

Gauteng has offered to host event if no other proposals are received by February Exco.

Note: Due to COVID-19, and its possible impact on 2020 KUSA Classic, Gauteng will make decision on 2021 by the end of March.

8. ELECTION OF KENNEL UNION MEMBERS IN TERMS OF ARTICLE 10(1)

8.1 27 New Members and 31 Members (lapsed) were elected.

8.2 Article 10 Membership – 10.2:

“ Any person who in the opinion of the Executive Committee has not misconducted himself in any way in connection with dogs, Training Classes and all events forming part of the Schedules of this Constitution or held under a Kennel Union licence, or in any way acted in opposition to the Code of Ethics, the fundamental objects and principles upon which the Kennel Union has been established, or in any other manner which would make it undesirable that he should be a Member, shall enjoy the privileges of a Member of the Kennel Union and shall be elected upon making written application on such form or in such manner as the Executive Committee may prescribe from time to time and paying an annual subscription fee as specified in terms of Schedule 7.”

“ The Executive Committee may refuse to elect any applicant and refund any subscription fee tendered. Any application received from any person who has been expelled from membership, or who has been convicted in a Court of Law for an offence described in Schedule 1 Rule 2.4 or Schedule 9 Code of Ethics, will be rejected automatically.”

A membership renewal form and fees have been received for Mr Duane Riley on the 06.03.2020. The membership renewal application form signed by the applicant includes the following declaration under “Conditions of Membership”:

“In making application to the Kennel Union of Southern Africa for Membership, I/we attest as follows and agree to comply with the following conditions:

3. I/We confirm that I/We am or not now nor ever have been suspended or expelled by KUSA, or any Club, registry body or Association concerned with animals.

I understand and agree that having voluntarily submitted this Membership Renewal Application, KUSA is under no obligation to approve it and that KUSA reserves the right to refuse acceptance of any Membership Renewal Application and to refund any Subscription Fees and Re-election Fees tendered.

After discussion it was agreed that the application be rejected in terms of Articles 10.2 and 10.3 and that the fees paid be refunded.

9. ANY OTHER BUSINESS

9.1 Applications for Affiliation/Closure

9.1.1 Working Deutsch Drahthaar Club

A request has been received together with payment, sponsoring letter and Constitution for the above Club to become affiliated to KUSA as a Specialist Breed Club (with disciplines). The Club held its inaugural meeting 13 March 2020. The Club has the support of the FTLC and is sponsored by the Working Retriever Club.

The KUSA Office has been advised as follows:

This Club will be under the jurisdiction of NAPC and approval was recommended at the NAPC Meeting held 6 February 2020.

A new Schedule under 5C to be drawn up for approval by Federal Council for the recognition of a new

Discipline i.e. Hunting Dog Tests

Only one Club name was suggest as above.

The KUSA Specimen Club Constitution has been adopted (Attached to Agenda)

Confirmation from Breed Standards Committee awaited.

10. GENERAL

10.1 MCA inquired whether the KZN Provincial Council proposal to request the reinstatement of the out of

Province CC was on the Fedco 06-2020 Agenda. Formal proposal to be forwarded to the KUSA Secretary.

10.2 Clarity is sought whether Show Licences paid for Shows that have been cancelled may be carried over or refunded. Waiting for directive from Task Team appointed by Fedco.

10.3 FTLC inquired about the Public Liability Notices that were made mention of in the minutes of the Fedco12-2019 meeting. NdP to revert.

11. DATE OF NEXT MEETING

Tue 21 April 2020 at 13h00.TBC.

(If COVID-19 national lockdown is extended beyond 16 April 2020, the KUSA office teleconference facility will not be available. Meeting to be conducted preferably via Skype or, alternatively, via Chorus Call Teleconference, which has cost implications.)
