THE KENNEL UNION OF SOUTHERN AFRICA MINUTES OF A MEETING OF THE EXECUTIVE COMMITTEE OF KUSA HELD ON TUESDAY 22 ndAUGUST 2017 AT 13H00 VIA TELECONFERENCE

1 ATTENDANCE, APOLOGIES & ANNOUNCEMENTS

2. MINUTES

The Minutes of the meeting held on 25.07.2017 were formally adopted, subject to the following amendment to item 5.2.3.6:

The comment at the end of this item has been amended to read:

“Noted and agreed that LW and JH should serve on the committee, it was also agreed members of Exco would put forward the name of 3rd person for the Consulting Committee at the next Exco meeting.”

3. ANY MATTERS ARISING FROM PREVIOUS MINUTES

3.1 Terms of Reference for Provincial Sub-Committees (Exco 07-2016 item 3.10, Exco 09-2016 item 3.8, Exco 11-2016 item 3.5, Exco 02-2017 item 3.4, Exco 03-2017 item 3.3, Exco 04-2017 item 3.3, Exco 05-2017 item 3.3. Exco 06-2017 item 3.3, Exco 07-2017 item 3.2)

Flowchart amended and circulated to Exco members on 30.06.2017.

After discussion, it was decided that the TOR document (not flowchart) should be re-sent to Exco Members and referred to Fedco.

3.2 Amendments to Club Constitutions

Saint Bernard Association of Northern Gauteng (Exco 06-2017 item 9.2.1, Exco 07-2017 item 3.9)

Cape Bullmastiff Club (Exco 06-2017 item 9.2.1, Exco 07-2017 item 3.9)

Sasolburg Kennel Club (Exco 6-17 Item 9.2.3, Exco 07-2017 item 3.8)

Deferred , pending directive from Fedco at Fedco 12-2017.

3.3 Ethics (Exco 06-2017 item 10.1. Exco 07-2017 item 3.10)

RJ to submit a proposal for the August or September Exco Meeting with regard to the formation of an Ethics Committee to address matters such as committee members showing at their own shows, Judges showing when a family member is judging and conduct of handlers in the ring.

Noted and agreed that the relevant FCI Regulations should be circulated to Exco Members.

3.4 Schedule 2 Regulation 16 – Breeder’s Restrictions (Endorsement) (Exco 07-2017 item 9.7)

At the July Meeting Exco considered a request for a Breeder’s Restriction to be placed nine (9) months after registration.

Fedco upheld Exco’s recommendation that no Breeder’s Restriction should be placed on the dog concerned and the applicant (breeder) has been advised accordingly.

Fedco 12-17 agenda for ratification.

3.5 Schedule 3 Regulations 38.3.2 and 38.4 Veterinary Certificates – (Exco 07-2017 item 9.5)

Following Exco’s agreement, in principle, at the July Meeting to issue a vet certificate iro a ten year old veteran dog that was castrated due to benign prostatic hyperplasia (BHP). The decision was to permit the dog to compete at the Supa 7s event only, which he has qualified for.

The Secretary was nevertheless asked to check if a certificate had been provided previously for a dog under similar circumstances. It was confirmed that such a certificate was issued by Exco in 2009. However, this was before the introduction of the Neuter Dog Class and before the following regulation was amended as indicated:

Schedule 3 Regulation 38.3.2:

No operation or act shall be performed ……save and except:

38.3.2.4 the spaying of bitches. The neutering of dogs, these male dogs may only be entered in the Neuter Dog Class.

Some guidance is requested as to whether it is permissible to continue to issue such certificates under these circumstances.

After discussion, it was agreed that the Regulations, as amended, are very clear and it was regretted that a certificate could not be issued under these circumstances.

4. KUSA OFFICE

4.1 Office Report

After discussion, the Office Report was approved.

4.2 FINANCE

After discussion, the Financial Report for July 2017 was accepted.

5. SUB-COMMITTEES

5.1 DISCIPLINARY SUB-COMMITTEE

Case 06-2015

Deferred, pending finalisation of civil case which has been postponed sine die. No further information at present.

Case 01-2017 – Witwatersrand Kennel Club vs Mrs CM Jacobs

The Disciplinary Sub-Committee (DSC) met on 11.07.2017 by teleconference and carefully considered all the evidence submitted. The DSC unanimously found the Respondent guilty ito 4.1.1 and 4.1.1.2 of Schedule 1 with regard to her conduct at the Witwatersrand Kennel Club Championship Show held on 26.03.2017, where she directed foul and abusive language at a show official. Such conduct was considered to be completely untoward and unacceptable in circles of sportsmanship.

The DSC imposed the following penalties, which take effect on 15 th August 2017 for a period of six (6) months, three months of which are suspended.

Rule 11.1.2:

Suspension or exclusion from taking part in, or having any connection with, or attending or participating or handling a dog at a Show, Obedience Class, Working Trial or Field Trial or other event held under KUSA licence, or from acting as an officer of a Club;

[NOTE: The penalty at 11.1.2 (re attendance at shows) does not relate to the dogs in a person’s ownership, viz it applies only to Mrs Jacobs in her personal capacity and does not in any way apply to dogs that are owned and registered or recorded in her name, or owned and registered or recorded by her jointly with another or others, viz such dogs may be entered and exhibited at KUSA-licensed events, provided that Mrs Jacobs is not present at the Show.]

Rule 11.1.5:

Disqualification from judging at, or taking part in the management of a Show, Obedience Class, Working Trial or Field Trial or other event held under a KUSA licence;

The initial three (3) months of the above penalties shall take effect on 15.08.2017. The remaining three months will be suspended for a period of three (3) years until 14.08.2020 , on condition that the Respondent does not contravene any of the provisions as provided for in Rule 4 of Schedule 1 or any other provision in the KUSA Constitution, Rules and Regulations that would form the basis for a valid complaint in terms thereof during the period of suspension.

Noted. No appeal was lodged.

Case 02-2017 – Initial notification procedure has been undertaken. Reply from Respondent being evaluated by SCI.

5.2 SHOWS

5.2.1 Applications for Second Championship Show

5.2.1.1 Highveld Rottweiler Club - 10th December 2017 – Breed

The above Club is requesting a second Championship Show to be held in conjunction with its first Championship Show, which has been moved from May to Dec due to Club issues which caused delays in organising the show timeously.

Motivation: -

The additional income will help the Club with its preparations for the National Grand Victor Show in 2018.

All Show returns, AGM/Financial Documents and penalties checked and all received.

There is no conflict with other events.

Approved.

5.2.1.2 Northern Tshwane Kennel Club – 20 May 2018 - Br, Dj, Ag, Fly, Hcl

The above Club is requesting a second Championship Show.

Motivation – letter circulated with agenda:

All Show returns, AGM/Financial Documents and penalties checked and all received.

There is no conflict with other events.

Approved.

5.2.1.3 SA Bulldog Club – 12 May 2018 – Breed

The above Club is requesting a second Championship Show on the same day as its first Championship Show.

Motivation:

To cut down on the exhibitors’ expenses, travel etc, i.e. if they attend they could possibly get 4CCs for the weekend.

As an incentive to increase entries.

The extra income will benefit the Club and KUSA making it a viable proposition.

It will be one venue for the day saving the Club extra cost.

The Club intends inviting an overseas judge for the first show and a local specialist judge for the second show ensuring a good income.

All Show returns, AGM/Financial Documents and penalties checked and all received. There is no conflict with other events.

Approved.

5.2.2 OTHER CLUB REQUESTS

5.2.2.1 Golden City Fox Terrier Club - Non-Championship Show - Sat 17 February 2018 (permanent date)

The above Club is requesting to hold a Non-Championship Show on Saturday, 17 February 2018, together with S.A. Ladies Kennel Association's first Championship Show. It is intended for this to be a permanent date and has the approval of S.A. Ladies Kennel Association. (See letter attached to agenda.)

After discussion Exco requested more detailed information, viz the relevant Regulations and any previous decisions made in respect of similar requests from this Club.

To be carried forward to next agenda.

5.2.2.2 IPO Club of Northern Areas

The above Club has been allocated to host the KUSA National IPO Event - 20-22 October 2017. All documents have been received, however the show is being held over three (3) days. IPO requires three days to fit the protection and tracking aspects of the event.

As per Schedule 3. Reg. 2.1 "Unless dispensation is granted by the Executive Committee, no Championship Show shall exceed two (2) days duration…..".

Dispensation granted.

5.2.3 KUSA CLASSIC

5.2.3.1 2017 – KwaZulu-Natal – 26, 27 & 28 May 2017

At the last meeting, PM undertook to circulate a profit and loss statement once the information from the Working Trials events held in Port Elizabeth has been received. Any further information will be tabled.

Information from the Working Trials event held in Port Elizabeth was awaited.

5.2.3.2 2018 – Free State & N Cape – 2&3 June 2018

Any response to decision made at July Meeting with regard to holding Breed and Working Disciplines over one weekend.

The Chairman reported that FS&NC Provco has requested dispensation to hold the 2018 KUSA Classic as originally planned, with the Breed events on 2&3 June and the Working Disciplines on 4 to 6 August. This request was due to the Exco’s decision that the events should be held over one weekend only being made at the July 2017 meeting.

Agreed.

5.2.3.3 KUSA National Disciplines – FS&NC Provco

See previous item.

5.2.3.4 2019 –Gauteng

Following discussion at Fedco informal meeting, the request for this event to be hosted by Gauteng is awaited.

Noted with the comment that once these Minutes have been ratified, submissions for 2019 will be requested.

5.2.3.5 Proposal for Procedure for KUSA Classic Events (Exco 06-2017 item 5.2.2.6. Exco 07-2017 item 5.2.3.6)

It was agreed at the July Exco Meeting that that LW and JH should serve on the Consulting Committee and also agreed that members of Exco would put forward the name of 3rd person for the committee at this meeting.

LW proposed that Clr BG Robinson (GR) be the third member of the Consulting Committee from 2019 going forward and he has kindly agreed to assist with the 2018 event with regard to any language problems.

Agreed.

5.2.3.6 2018 – KUSA National Working Trials (Classic)

The Transvaal Working Trials Association (TWTA) has applied to host the KUSA National WT (Classic) Event in 2018 (date to be confirmed). The office would like confirmation that a Non-Championship showholding Club may host a KUSA National event as they organise and run various Championship WT Events on behalf of other Clubs in Gauteng. The NAPC W/T Sub-Committee has no hesitation in recommending TWTA as hosts for this event.

After discussion, the above request was agreed.

5.3 JUDGES – BREED

5.3.1 The following Judges have completed KUSA requirements and are licensed for the Group/s as listed:

Mrs J Hubbard (GAU) - Working Group & is now an All Breeds Judge.

Unconfirmed Minutes of FTLC Meeting held on 06.07.2017

The above Minutes were tabled at the July Exco Meeting and the following item was overlooked:

SA Hunting Retrievers

“Mr Hoy asked if the use of the SAHR cards is still relevant in view of the fact that all information and records are captured on the FT database. Mrs Wynne to establish whether KUSA will accept the results obtained from the FT database if a card was not signed by all the Judges.”

Pages 8&9 of Schedule 5C (Reg A.4.5) attached to agenda.

Discussion indicated a concern about creating a precedent and also continuity, should the individual who currently captures the records no longer be available for whatever reason. It was also suggested that the FTLC should first submit proposed changes to Schedule 5C, which currently makes provision for a record card.

LW undertook to contact Dr Kloeck for clarification once the documents have been received.

Any further information regarding election of new Convener will be tabled.

LW referred to an email dated 27.07.2017 from a member of the Carting NSC. It is suggested that, since there is so little time left this year to elect a new Convener, it be accepted to hold the post over until January 2018. Each provincial sub-committee could send an annual report directly to the Secretary.

9.6 Schedule 3 Regulation 14 – Biting Incident – RWBA 22.07.2017

Report received from RWBA regarding incident whereby Rottweiler Dog, Boschkop Azrael, Reg No ZA014949B16 (registered owner Mrs AC Fischer), bit the Judge on the hand when he approached the dog to evaluate his teeth. A copy of the report and recommendation from the Show Committee are attached. Ito the regulations, a barring notice was issued.

Correspondence from the Judge stating that, in his opinion, no action should have been taken.

Page from KUSA Representatives Report – stating the same as the Judge.

Emails from registered owner advising, inter alia, although she is the registered owner, she had sold the dog and it was being handled by his new owner who is taking the dog for regular training.

Since the above, various other representations have been submitted by the registered owner on behalf of the dog. In addition to a video, there are statements from individuals who have interacted with Azrael.

Despite the above, Exco re-confirmed the decision made at the July Meeting, viz Exco is of the opinion that Azrael should first successfully pass a CGC (bronze) using the same handler as when the incident occurred. Thereafter, application should be made to Exco to appoint three judges to assess the dog under exactly the same conditions as when the incident took place. Should the dog pass this assessment, the bar will be lifted and the dog may be exhibited again at KUSA Shows.

9.7 Suspended person attending a KUSA Show – Dr L Powell

Letter received from the Chairman of KZN Junior Kennel Club reporting that Dr L Powell attended its Championship held on 04.08.2017. Dr Powell is banned for life. This includes suspension from attending any Shows. She was asked to leave, but refused to do so.

10. GENERAL

10.1 Schedule 5E(12) Regulations for Handler of the Year Competition

LW proposed the following change to Regulation 8.7.1:

Delete words in [brackets] and insert words underlined:

Handlers will enter the ring in draw order (not catalogue order) initially competing with their own exhibits. The Judges will shortlist four (4) Handlers and the four (4) shortlisted Handlers will be given a short break to bench their own exhibits, [ after which they will be required to handle four (4) new exhibits. Each Handler will be required to handle all four (4) new exhibits, subject to the provisions of 8.6. after which each of the four (4) shortlisted Handlers, will be required to handle two (2) new exhibits, chosen by the Judges from a list of breeds provided by the organisers subject to the provisions of 8.6.

Agreed to recommend to Fedco.
